Can I Build a Garage Apartment?

Often yes — garage apartments (ADUs above or attached to garages) are among the most popular ADU types, and the ADU liberalization covers them: many states and cities now mandate ministerial ADU approval. The design challenges are the garage's structure, which must support a dwelling above it; the fire separation, with living space sitting directly over the garage's hazards; and access, since an exterior stair must satisfy the zoning rules. Solve those three and the project is a standard ADU.

Structural

Start with the existing garage's capacity. Its footings and walls were designed for a one-story storage building, and they rarely support a dwelling — plan on new or reinforced structure. The floor system spans the garage below: at 20-plus-foot clear spans, that means engineered beams and joists, not nominal lumber. The lateral system needs attention at the open garage front, where the wide door opening creates a soft story; shear-wall detailing, holdowns, and strapping tie the apartment above to the foundation below. A structural evaluation ($1,500-$3,000) precedes design and tells you how much of the three the project needs.

Fire separation and code

The code treats the apartment as a house that happens to sit on a garage. The dwelling-garage separation follows the residential garage rules: 5/8-inch Type X gypsum on the garage ceiling, 1/2-inch on the supporting walls, and a 20-minute-rated, self-closing door between the garage and any living space or stair. Carbon monoxide is the quiet half of the detail — CO alarms in the dwelling and thorough air-sealing so garage exhaust cannot migrate upstairs. The apartment itself meets the full residential code: sleeping-room egress, ceiling heights, a real kitchen and bath. Whatever it sits on, the apartment is a dwelling.

Zoning and cost

Zoning runs through the ADU ordinance: the size cap, the height limit (a two-story garage apartment tests it), and setbacks — an existing garage's nonconforming setbacks may or may not be grandfathered for the conversion, which is a question to ask before design. Parking requirements for the ADU are waived near transit in many jurisdictions. Access is a design and zoning decision together: an exterior stair must satisfy the encroachment rules, while an interior stair costs floor space. Cost runs $200-$350+/sq ft for the structural work, the stair, and the full dwelling fit-out. The permitted garage apartment is rental income; the unpermitted one is a liability.

The bottom line

Garage apartments work as ADUs (ministerial approval in many jurisdictions) — verify the structure supports the dwelling, detail the fire separation, and check height/setback zoning. Budget $200-$350+/sq ft.
