Can I Put a Tiny Home on My Property?

It depends on what 'tiny home' means legally — and the legal category determines everything. A tiny home on a foundation is usually an ADU or small dwelling (permitted where ADUs are allowed). A tiny home on wheels (THOW) is legally an RV in most jurisdictions — permitted temporarily, restricted permanently, and rarely allowed as a dwelling. The wheels are the legal problem, not the size.

Foundation tiny homes

Built on a permanent foundation and meeting the residential code (or the IRC's tiny-house appendix: minimum room sizes, ceiling heights, loft rules, egress), a tiny home permits like any small house or ADU. The ADU path is the common route: size limits, setbacks, and utility connections per the local ADU ordinance. Some jurisdictions have tiny-home-specific ordinances streamlining the process.

Tiny homes on wheels

Legally RVs in most states: allowed in RV parks and campgrounds, generally prohibited as permanent dwellings in residential zones. Some jurisdictions now allow THOWs as ADUs with conditions (skirting, utility connections, RVIA or NOAH certification). The certification matters — RVIA-certified units meet the RV standard; NOAH certification addresses the dwelling-code gap. Without a local ordinance explicitly allowing THOW dwellings, assume prohibition.

Practical path

Check the ADU ordinance first (foundation tiny home = ADU in most cases), then ask the building department specifically about THOWs if wheels are involved. Utility connections (sewer/septic, water, electrical) cost the same regardless of the home's size — the $15,000-$40,000 in tap fees and connections surprises tiny-home buyers. Zoning compliance first, then building code, then utilities — in that order.

The bottom line

Foundation tiny homes permit as ADUs/small dwellings; tiny homes on wheels are legally RVs and restricted as permanent dwellings. Check the ADU ordinance and ask about THOWs explicitly.
