How to Get a Building Permit in Texas?

Texas has no state building code — building permits are purely local, issued by cities (and some counties for unincorporated areas). The process varies enormously: Houston famously has no zoning (but has building codes and deed restrictions), Austin and Dallas have full zoning and rigorous review. The universal steps: determine the AHJ, verify zoning, prepare code-compliant plans, submit, respond to corrections, and inspect.

Know your AHJ

Incorporated city: the city's building department (permits, plan review, inspections) plus zoning compliance. Unincorporated county: counties have limited building-code authority in Texas — many unincorporated areas have no building permits at all (but septic, floodplain, and driveway permits still apply). ETJ (extraterritorial jurisdiction): cities regulate subdivision and some development outside their limits. Verify the AHJ before designing — the rules change at the city-limit sign.

Zoning and deed restrictions

Where zoning exists, verify the use, setbacks, height, and parking before designing. Houston's lack of zoning does not mean no rules: deed restrictions (private covenants) function as zoning in much of Houston, enforced by HOAs and neighbors through lawsuits — check them. Floodplain regulations (post-Harvey, Houston's are strict) and the Edwards Aquifer rules in Central Texas add layers.

The permit process

Commercial: full plan review (building, MEP, civil, structural by a Texas-licensed PE), energy code compliance (IECC as adopted locally), TAS accessibility review, and health department for food uses. Residential: simpler but still plan-checked in most cities. Texas engineers stamp per TBPE rules. Timelines: 2-8 weeks for straightforward permits in most Texas cities, longer in Austin. Windstorm design (TWIA) applies on the coast — separate certification.

The bottom line

Texas permits are local-only — verify the AHJ (city vs. unincorporated county), check deed restrictions especially in Houston, and plan 2-8 weeks for standard permits plus TWIA windstorm certification on the coast.
