What Is a Jurisdictional Determination for Wetlands?

A jurisdictional determination (JD) is the Army Corps of Engineers' official ruling on whether wetlands or waterways on a property are 'waters of the United States' subject to Section 404 permitting. It follows the wetland delineation: the delineation maps what is wet, the JD decides what is regulated. A JD is typically valid for five years and is the document lenders, buyers, and agencies rely on.

Approved vs. preliminary JDs

An approved JD is the Corps' formal, appealable determination — definitive for five years, relied upon by all parties. A preliminary JD is advisory: the Corps treats all mapped aquatic resources as jurisdictional without deciding, which is faster but leaves the question open. Sellers often prefer approved JDs (certainty for buyers); permit applicants sometimes prefer preliminary (speed). The choice is strategic — discuss it with the environmental consultant.

The process

The wetland scientist submits the delineation report to the Corps district; the Corps reviews, may field-verify, and issues the JD. Timelines run 3-12 months depending on the district's backlog — start early. The JD map becomes the basis for the 404 permit application: impacts are quantified against the JD's jurisdictional acreage. Post-Sackett (2023), the scope of jurisdiction narrowed significantly — many features previously regulated are not, which makes the current JD more valuable, not less.

How owners use it

With an approved JD showing no jurisdictional waters, the property develops without 404 permitting — the highest-value outcome. With jurisdictional areas mapped, the site plan avoids them or the 404 permit quantifies the impacts and mitigation. Never buy, entitle, or design around wetlands without the JD: the delineation is the consultant's opinion, the JD is the government's answer.

The bottom line

The JD is the Corps' official ruling on which wetlands are federally regulated — approved JDs give five years of certainty. Get it before buying, entitling, or designing near mapped wetlands.
