What Is a NEPA Environmental Review?
The National Environmental Policy Act requires federal agencies to assess the environmental impacts of their actions — including projects they fund, permit, or approve. If your project needs a federal permit (Section 404, for example) or federal funding, it needs NEPA review: a Categorical Exclusion, Environmental Assessment, or full Environmental Impact Statement depending on the impact level. NEPA is the timeline driver on federally connected projects.

The three review levels
Categorical Exclusions (CE): routine actions with no significant impact — documented quickly. Environmental Assessments (EA): for actions that might have impacts — analyzes alternatives and either finds no significant impact (FONSI) or escalates. Environmental Impact Statements (EIS): for major actions significantly affecting the environment — multi-year studies with public comment, alternatives analysis, and mitigation commitments. The level is set by the federal agency, not the applicant.
What triggers NEPA for private projects
The federal nexus: a Section 404 wetlands permit, a federal loan or grant, work on federal land, or a federal agency approval. Private projects with no federal connection skip NEPA (state equivalents like CEQA in California may still apply). The trigger is often the 404 permit — which is why wetland impacts bring both the Corps permit and the NEPA review together.
Timeline and strategy
CEs: weeks to months. EAs: 6-18 months. EISs: 2-5+ years. The strategy is avoiding the higher levels: design the project to qualify for a CE or a mitigated FONSI by avoiding sensitive resources (wetlands, endangered species habitat, historic properties) in the first place. Early coordination with the federal agency — before the design is final — is how experienced teams keep the review at the lowest level.
The bottom line
NEPA review applies to projects with a federal nexus (permits, funding) — CE, EA, or EIS by impact level. Avoid sensitive resources in design to stay at the lowest review level; an EIS takes years.
